The Honourable Mr Justice Horner
Business & Property Hub Update from the Courts
Mr Justice Horner was called to the Bar in 1979. He was appointed a QC in 1996. At the Bar he had a wide and varied practice with a particular interest in commercial disputes, Chancery and professional negligence cases and personal injury litigation. His areas of special interest include practice and procedure in this and other jurisdictions, chancery, commercial litigation and public law. Mr Justice Horner is the Chairman of the Judges’ Council, Chairman of Northern Ireland sub-committee of European Network of Councils for the Judiciary (ENCJ) looking into minimum standards for judges across Europe, a Coroner appointed to hear legacy Inquests and President of the Lands Tribunal.

Over thirteen years’ experience specialising in commercial and chancery litigation, insolvency law and company disputes. Extensive experience in advising and representing government departments, insolvency practitioners and private clients in commercial and insolvency-related matters. Author of Litigation in the Commercial List in Northern Ireland published in 2012. Part-time tutor at the Institute for Professional Legal Studies in Belfast, and coaches and supports senior school students interested in the legal profession, and in providing training for expert witnesses in civil court cases.
Michael Humphreys QC

Michael practises mainly in the areas of Chancery and Commercial law, which extends to litigation, arbitration, adjudication and mediation as forms of dispute resolution. He particularly specialises in construction disputes, public procurement challenges, banking and professional negligence actions for and against solicitors, architects, surveyors and financial advisors. Michael is currently Chair of the Commercial Bar Association and member of the Commercial Court Liaison Committee.
Challenging Adjudications on Lack of Payless Notice
Where are we now ??
Up until the recent decision in Grove Developments Limited v S&T, employers who failed to serve a pay less notice on time often ended up on the wrong end of a ‘smash and grab’ adjudication decision, resulting in a requirement to pay their contractor, as well as legal and other fees involved in the process. However, the TCC has now given its blessing to a way for employers to try and gain the upper hand. We will be looking at the current position of the courts and what is the best way to advance and defend actions on a Payless point.

Jarlath is a Chartered QS who has specialised in Contractual issues and dispute resolution for almost 20 years. He is Director of Elemental Consultants and has extensive experience in the management and settlement of major construction arbitrations, adjudications and mediations. He is qualified to act as Arbitrator, Adjudicator or Mediator in commercial matters and also receives appointments as Expert Witness on quantum matters and valuation of loss and expense. Jarlath is the Chair of the NI Chapter of the CIArb and local convenor for the Adjudication Society.
